Lagos Family Estate Dispute: Alleged Trespass, Marketing of Ojota Property Deepen Legal Battle
The dispute over the ownership, administration and beneficial interests in a family estate in Ojota, Lagos, appears to be entering another contentious phase, with one of the documented administrators and beneficiaries raising fresh concerns over alleged trespass, construction activities and attempts to market a disputed property.
At the centre of the latest controversy is the property located at 406 Ikorodu Road, Ojota, Lagos, formerly known as Ojota Motel, which is said to be connected to the estate of the late Alhaji Kazeem.
Fadeel Kazeem, identified in the relevant Letter of Administration as one of the administrators and a legal beneficiary of the estate, alleged that activities had continued at the property despite ongoing legal proceedings touching on the ownership, administration and beneficial interests associated with the estate.
For Fadeel, the issue goes beyond a disagreement among members of a family. He contends that where an estate property is the subject of unresolved legal proceedings, actions capable of altering, occupying, developing, marketing or disposing of the property could create additional complications for all parties claiming an interest in it.
According to him, the property was demolished on May 2, 2026, following earlier regulatory proceedings. He alleged that after the demolition, activities resumed at the premises, including the movement of persons onto the property and the removal of rubble.
He further alleged that blocks were subsequently erected on the site and that other activities were undertaken there. The allegations, if established, raise questions about the authority under which such activities were allegedly carried out while the property remains connected to an unresolved family and legal dispute.
The administrator said his concerns were heightened by his stated responsibility to protect the interests of the estate and preserve properties whose ownership or beneficial interests remain contested.
His position, according to the Letter of Administration supplied in support of his claims, is not merely that of a distant family member. He identifies himself as an administrator and beneficiary, a status which he says gives him both an interest in the estate and a responsibility to ensure that its assets are not improperly dealt with.
The dispute has also taken on a commercial dimension following allegations that the property was being marketed or otherwise positioned for disposal while the underlying issues remained unresolved.
That development, Fadeel alleged, could expose unsuspecting members of the public to potential disputes if prospective purchasers or investors commit money to a property whose ownership and beneficial interests are still being contested.
In an apparent effort to alert the public, a notice bearing the warning “CAVEAT EMPTOR — BUYER BEWARE” was published in a national newspaper on July 10, 2026, concerning the property.
The notice, according to Fadeel, was intended to draw public attention to the dispute and caution prospective purchasers, investors and other interested persons to conduct appropriate searches and obtain independent legal advice before entering into any transaction concerning the property.
The warning reflects one of the recurring complications in disputed family estates: the possibility that a transaction involving contested property could create new layers of litigation involving parties who were not originally connected to the dispute.
Fadeel therefore advised anyone contemplating a transaction involving the Ojota property to independently verify its legal and registration status and seek professional advice before committing funds.
Beyond the property itself, the dispute has allegedly generated tensions among members of the family, with Fadeel also raising allegations of threats and intimidation involving some beneficiaries and other persons connected with the estate.
He alleged that some family members had come under pressure while attempting to assert or protect what they regarded as their lawful interests in the disputed properties.
Such allegations have added another dimension to an already complicated dispute, as disagreements over property ownership can become particularly sensitive when competing claims involve members of the same family.
Fadeel said complaints concerning the disputed properties had also been brought before the Lagos State Ministry of Justice Special Task Force on Land Grabbers, calling for allegations of threats, harassment, intimidation or unlawful interference to be properly documented and investigated.
He urged the relevant authorities to ensure that any criminal or unlawful conduct alleged in connection with the dispute is subjected to appropriate investigation rather than allowing the family disagreement to escalate further.
The wider dispute is said to extend beyond the Ojota Motel property to No. 7 Alhaji Kazeem Street, Ojota, and other properties which the claimant says form part of the estate.
Among the legal proceedings cited by Fadeel is Suit No. ID/ADR/3246/2025, while related complaints are said to remain before the Lagos State Ministry of Justice Special Task Force on Land Grabbers.
The significance of the ongoing proceedings is that the competing parties have an established legal avenue through which their respective claims can be presented, challenged and determined.
For Fadeel, preservation of the disputed properties pending the resolution of those issues is therefore central to preventing further complications. He maintained that persons claiming legitimate interests should pursue those interests through lawful processes rather than through actions that could alter the status of contested properties.
The dispute also illustrates the difficulties that can arise where estate administration, family relationships, property development and competing claims intersect. Until the relevant legal questions are finally determined, allegations by one side cannot, by themselves, establish ownership or wrongdoing by another.
The claimant’s allegations concerning trespass, construction, marketing, threats and intimidation have not been established by a final judgment of the court. The defendants and other persons referred to in connection with the dispute remain entitled to respond to the allegations and present their respective positions before the court and appropriate authorities.
For now, the central questions remain matters for the judicial and regulatory processes: who has the lawful authority to deal with the disputed properties, what interests form part of the estate, and what actions, if any, may properly be taken while the proceedings remain pending.
The controversy surrounding 406 Ikorodu Road therefore remains more than a dispute over a physical parcel of land. It is a contest involving estate administration, alleged beneficial interests, competing claims and the protection of property pending legal determination.
Fadeel said his stated objective is to preserve the disputed properties and protect the interests of beneficiaries while the relevant proceedings continue. Whether the allegations withstand legal scrutiny, however, remains a matter for the appropriate authorities and ultimately the courts to determine.
