The Management of Fatgbems Petroleum Company Limited (Fatgbems) would like to respond to the publication in several national dailies and social media platforms of Friday June 25, 2020 with the headline “AMCON seizes properties at Isheri over N9.8bn debt.”
We like to officially state that the “CAVAET EMPTOR: POSSESSION TAKEN BY COURT ORDER” action of AMCON is in respect of SUIT NO: FHC/L/CS537/2020- ASSET MANAGEMENT CORPORATION OF NIGERIA V. KNIGHT ROOK LIMITED, GRANT PROPERTIES LIMITED AND FIBIGBOYE ESTATES LIMITED (ALL RECEIVERSHIP) in respect of a large parcel of land measuring about 30 hectares, and immediately abutting our OPIC Isheri service station.
For the avoidance of doubt, Fatgbems categorically states that it is not a party to the above mentioned suit, neither is it a related party or affiliate of any of the said parties. Furthermore, Fatgbems is not indebted to AMCON in respect of any facility whatsoever, and has not mortgaged the said property, or any of its properties for any facility with AMCON.
The property upon which Fatgbems’ service station at Opic Isheri, is situated has a Deed of Sub Lease by the Ogun State Property and Investment Corporation and with a signed consent of the Governor of the state dated April 2000.
We are persuaded that the action of AMCON may have been in error, given that Fatgbems’ service station shares boundary with a portion of the large parcel of land mortgaged to AMCON by the above companies in receivership.
Our lawyers have immediately brought this to the attention of AMCON and its advisers, and we are confident that the error will be rectified swiftly.
