The trial of former Central Bank of Nigeria (CBN) governor, Godwin Emefiele, is entering a decisive phase as mounting delays and unresolved witness issues continue to cast doubt over the prosecution’s ability to sustain its case concerning the alleged missing $6.23 million from the bank’s Abuja branch.

Fresh indications suggest that the federal government may again notify the FCT High Court of the unavailability of a key witness, Commissioner of Police Elohor Edwin Okpoziakeo, who is reportedly tied up in another court engagement. This development, if presented, could further stall proceedings and delay the anticipated testimonies of both the police commissioner and Jim Obazee.

However, the court’s tolerance for delays appears to be reaching its limit. Having already granted eight adjournments—beyond the statutory allowance of five—there is growing pressure on the presiding judge to take a firm stance. Legal observers note that continued failure by the prosecution to present its key witness could compel the court to vacate the case for lack of diligent prosecution.

Behind the scenes, sources reveal that the prosecution’s strategy has been anything but consistent. The earlier plan to rely on the police commissioner as a central witness was reportedly abandoned over concerns that it might weaken the case. This shift has redirected attention to Obazee, whose investigation into the apex bank is widely regarded as the foundation of the allegations.

An official of the Economic and Financial Crimes Commission (EFCC) is said to have reached out to Obazee, who has expressed willingness to testify if formally invited. Yet, his continued absence from court proceedings has intensified speculation that critical testimony is being withheld at a crucial moment.

Justice Hamza Muazu had earlier issued a clear directive on March 17, ordering the EFCC to produce its key witness by April 27 or face possible legal consequences. The directive came after repeated adjournments that have slowed the momentum of what is considered one of Nigeria’s most high-profile financial crime trials.

The case originates from a July 2023 appointment by President Bola Tinubu, who tasked Obazee, former head of the Financial Reporting Council, with investigating alleged financial irregularities within the CBN and related government entities. His preliminary report, submitted in December 2023, highlighted the disappearance of $6.23 million and recommended the prosecution of several individuals.

Further complicating the prosecution’s efforts are reports that some individuals initially listed for prosecution—including Boss Mustapha—have now been repositioned as government witnesses. Analysts argue that such a move could weaken the coherence of the case and blur the lines of accountability.

Beyond the central allegation, Obazee’s findings reportedly uncovered a broader pattern of financial misconduct, including unauthorized currency issuance, controversial “ways and means” financing, disputed COVID-19 expenditures, and the alleged diversion of over N17 billion through multiple financial institutions.

As the case drags on, the spotlight is now firmly on the court. With procedural limits already stretched and key witnesses yet to appear, pressure continues to build for a decisive ruling—one that could either revive the prosecution’s case or bring it to an abrupt end by vacating the charges against Emefiele.
